What counts as work with open flame

Welding, thermal cutting, grinding and other ways of processing metal in places where a fire or explosion can occur are activities with an increased risk of fire. So is gluing flammable floor and roof coverings using flame, and any necessary handling of open flame in places where a fire can occur (Section 1(1) of Decree of the Ministry of the Interior of the Slovak Republic No. 121/2002 Coll.).

For such activities the statutory body of the legal person or the self-employed person must issue a written instruction on ensuring fire protection (Section 3(2) of the same decree). A verbal arrangement with the welder is not enough.

It covers the designation and equipment of fire watch teams, the means for fighting a fire, the persons responsible for individual measures, the content and scope of the training of the fire watch members, the content of the training of the people taking part in the activity, and the way compliance is checked (Section 3(3)).

A permit-to-work form for hot work together with the procedure for issuing it, supervision during the work and the check of the workplace after the work is finished.

Supervision on site during shutdowns, repairs and installations, when welding takes place in production or on a roof.

Contractors: who is responsible

If activities with an increased risk of fire are carried out for you by another company, these tasks are performed by the party for whom the activities are carried out, unless a special regulation or a written agreement provides otherwise (Section 3(4) of Decree No. 121/2002 Coll.). In other words, if you have not agreed it with the contractor in writing, it stays with you.

In explosive atmospheres the rules are stricter

In areas classified into zones, the employer must set up a permit-to-work system for work that may create a risk of explosion. The permit is issued before the work starts by an authorised employee and must state the responsible persons, the manner of supervision, the workplace, the list of the work party and the period of validity (Annex 2 to Government Regulation No. 393/2006 Coll., points 2.2.2 and 2.2.3).
